These Terms of Service (“Terms”) govern your use of the website zesterex.pro and the design and drafting services provided by Zesterex, LLC, a Delaware limited liability company (“Zesterex”, “we”, “us”), 800 N King Street, Suite 304, Wilmington, DE 19801, United States. By using our website or engaging our services, you agree to these Terms.
1. Our services
Zesterex prepares mechanical, electrical, plumbing, structural, fire protection, architectural and energy-compliance design and drafting deliverables as a production partner. Where a professional engineer’s seal is required, a US-licensed professional engineer retained by Zesterex or engaged for the project reviews and stamps the work as engineer of record. Zesterex does not offer engineering services requiring licensure in jurisdictions where it is not licensed and does not act as engineer of record.
2. Quotes, scope and changes
Each project is defined by a written quote or proposal that states the scope, deliverables, price and schedule. Work begins when you accept the quote. Changes to scope, jurisdiction, design intent or inputs after acceptance may change the price and schedule and will be agreed in writing before the additional work begins.
3. Fees and payment
Unless the quote states otherwise, fees are payable 40% on acceptance and 60% on delivery of the final set; projects over USD 10,000 are billed 40% on acceptance, 30% on the first permit set and 30% on final delivery. Invoices may be paid by card or bank transfer (ACH). Final files are released once the balance is paid. Late payments may delay delivery and may accrue interest as permitted by law.
4. Your responsibilities
You agree to provide accurate and complete project information, applicable drawings, site conditions, jurisdiction requirements and timely responses to our questions. You are responsible for obtaining necessary permits and approvals and for verifying that deliverables are used in accordance with local codes and regulations.
5. Revisions and plan-check support
Responses to plan-check comments on the permitted scope are included. Errors made by Zesterex are corrected at no charge. Revisions arising from client-requested changes, new information or changed requirements are quoted separately.
6. Intellectual property and confidentiality
Upon full payment, you receive the right to use the deliverables for the project for which they were prepared. Client drawings, standards and project information are treated as confidential and are not reused or published without written permission. Zesterex may describe projects in anonymized form (project type and location only) unless you ask us not to.
7. SMS and communications
If you provide your mobile number and consent to receive text messages, we may send project-related SMS messages (status updates, delivery notifications, scheduling reminders and support replies). Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance. Consent to SMS is not a condition of purchase. 8. Warranties and limitation of liability
Zesterex will perform its services with reasonable professional skill and care. Except as expressly stated, the services are provided without other warranties. To the fullest extent permitted by law, Zesterex’s total liability for any claim arising from a project is limited to the fees paid for that project, and Zesterex is not liable for indirect, incidental or consequential damages, including loss of profit or project delay.
9. Website use
Website content is provided for general information and may be changed without notice. You may not use the website for unlawful purposes, attempt to gain unauthorized access, or copy site content for commercial use without permission.
10. Termination
Either party may terminate a project by written notice. You will pay for work completed to the date of termination. Sections 6, 8 and 11 survive termination.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise agreed in writing.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows the current version. Continued use of our website or services after changes means you accept the updated Terms.
